Overview
This document outlines the terms of service for services rendered (”Commissioned Artwork”) by Prince Potion (the “Artist”) for the client (the “Commissioner”). This document only applies to personal use Commissioned Artwork. For business purposes, a different document will be drafted. This is a living document that will be updated as necessary.
Usage
- Commissioned Artwork is for personal, non-commercial use only. If you are interested in artwork that can be monetized, please contact the Artist to discuss details.
- The Artist retains all rights the Commissioned Artwork, for purposes such as portfolios, social media, or merchandise. The Commissioner must discuss other options with the Artist before payment and start of work, and such terms will require a fee.
- The Commissioner and respective owners retain all rights to the characters depicted in the Commissioned Artwork, provided they possess such rights.
- In the case of selling characters depicted in the Commissioned Artwork, the Commissioner may not sell the Commissioned Artwork for more than they paid the Artist at the time of work.
- If the characters depicted in the Commissioned Artwork are traded (without a monetary transaction), the Commissioned Artwork loses all monetary value and may only be traded or gifted henceforth.
Process
- Once the Artist has accepted your commission request, the Artist will provide the Commissioner with a quote.
- The Artist will provide progress updates throughout the commission process to the Commissioner. If the Commissioner has any concerns or requests for changes, they must let the Artist know as soon as possible.
- The Artist offers one round of revision to the Commissioned Artwork before it is completed (generally, after the sketch phase). Revisions after the Commissioned Artwork has been completed will incur an additional fee.
- Once the Commissioned Artwork is complete, the Artist will provide the Commissioner with a high-resolution PNG file.
Payments
- Payments to the Artist from the Commissioner shall be paid via Stripe or Kofi.
- 100% payment is required before any work on the Commissioned Artwork begins.
- If the Commissioner wishes to cancel their order of the Commissioned Artwork, the price of the Commissioned Artwork will be kept as a cancellation fee.
